Today, employer-employees relationship has become complex, governed by various legislations which need to be understood and which employers must conduct their employees relationship within the parameters. Improper implementations of Employment Act and other legislations, and improper handling of Disciplines and Domestic Inquiry procedures can result in the Labour Court and the Industrial Court ruling in favour of employees and costly monetary compensation.

Introduction to Employment

  • Acknowledge the employer – employee relationship defined by employment act
  • The employment contracts, and terms and conditions of employment.

Identifying and Handling Misconduct & Disciplinary Issues

  • Distinguish the difference between self-discipline & enforced discipline
  • Recognize the types of misconduct and analyze misconduct
  • Negligence and willful disobedience
  • Establish the Level of Severity
  • Distinguish between a genuine Grievance and an Act of Misconduct
  • The Disciplinary and Grievances Procedures.

Due Inquiry

  • Understand the Principles of Natural Justice, and the application of Natural Justice in Domestic Inquiry.

Investigating Misconduct

  • Determine whether suspension is necessary, and Taking Witness Statement.

Domestic Inquiry

  • Learn how to prepare & draft charges and notice of DI
  • Identify role of various parties at an inquiry
  • Evaluate evidence adduced at the inquiry/arriving at a decision
  • Meting out correct punishment and mitigation
  • Learn how drafting suspension, termination & dismissal letters
  • B aware of the other issues such as breach of contract, constructive dismissal, the employee right to redress or appeal.
